24Seven – Subscription Agreement
This Agreement is in addition to the Private Membership Agreement – Terms & Conditions with Zilch Fleet Solutions Limited trading as Zilch. All terms within the Private Membership Agreement shall apply unless inconsistent with any specific provisions of this Agreement, in which case the following provisions do apply.
1 Agreement
You confirm your understanding that you are undertaking the lease of a vehicle as per this Agreement and will be charged a monthly recurring charge as set out in the Schedule.
2 Term of Lease
The term of the Lease is set out in the Schedule. Any amendments must be confirmed in writing by both parties.
If you return the vehicle earlier than the agreed date, you many be required to pay an additional charge.
3 Start of Lease
The start of the Lease is the date set out as per the Schedule.
4 Extensions
If you wish to extend your term, you must notify Zilch in writing no less than 14 days from the end of term. There is no guarantee that the same or similar vehicle will be available for an additional term.
Unless previously agreed, all usage outside of your selected period will attract standard pricing (see www.zilch.nz).
We will charge your uploaded payment method for any unauthorised extensions on a daily basis.
5 End of Term
You agree to return the vehicle on the agreed date, to the location set out in the Schedule. If you fail to do so, you will be liable for any costs associated with returning the vehicle to agreed location.
You agree to return the vehicle in a clean, tidy, and litter-free condition. Any vehicle returned in a dirty or soiled state may result in a cleaning fee (as per our Fees, Charges, and Interest Schedule available at www.zilch.nz (this will be charged at the discretion of Zilch).
On return of the vehicle, you will complete a damage check. You may be liable for any damage that has not been notified to Zilch.
6 Insurance
All Vehicles are insured. You will be liable for paying the excess in the event of any accident. The amount of this excess is set out in the Schedule. Any driver of the vehicle must have signed up to Zilch and agreed to the Private Membership Agreement – Terms & Conditions.
7 Damage
You will complete a damage check at the start of your lease. It is your responsibility to notify Zilch of any new damage during your lease. On return of the vehicle, you may be charged for any new damage not previously notified.
8 Cancellation
You must notify Zilch at least 14 days in advance if you wish to cancel your lease early. Zilch will recalculate your monthly rate based on the return date and any refund or charge will be actioned once the new return date has been agreed.
9 Fees and Charges
The first payment will be for the first 4 weeks in advance. Going forward you will be charfed every 4 weeks in advance, plus any costs incurred for the previous cycle.
10 Amendments
Zilch may vary these Terms and Conditions by putting the varied terms on its website.
Amendments are deemed to have been received:
- if personally delivered (whether in person or by telephone), on such delivery;
- if posted, within two days of posting;if posting on our website, on the day after the day on which our website is updated to include such notification; orif sent by email, on successful transmission or, if sent after 5pm, on the next business day after transmission.
- If this subscription continues for six months or more, we reserve the right to register a security interest over the vehicle on the Personal Property Securities Register. By entering this agreement, you consent to such registration.
